Terms of Use

1. About the Service

Rtriv is an iOS mobile application published by Benoit Gainnier, sole trader registered in France (SIRET: [TO BE COMPLETED]), located at [ADDRESS TO BE COMPLETED] — contact: contact@rtriv.io. Rtriv is a personal content management service that allows users to save, AI-enrich, and retrieve content from social networks and the web.

2. Acceptance of Terms

By using the Rtriv application, you fully and unconditionally accept these Terms of Use. If you do not accept these terms, you must not use the service.

3. Access to the Service

3.1 User Account Access to Rtriv requires creating an account with a valid email address or via Apple Sign In. You are responsible for keeping your credentials confidential. 3.2 Minimum Age The application is intended for users aged 13 and over. By creating an account, you confirm that you meet the age requirement. 3.3 Availability Rtriv endeavors to keep the service available at all times but does not guarantee uninterrupted availability. Maintenance or technical interruptions may occur without prior notice.

4. Plans and Subscriptions

4.1 Free Plan The free plan is accessible without a credit card. It includes 25 saves per month, a daily quota of 1 to 2 items, and 1 collection. Included features may evolve over time. 4.2 Rtriv+ Plan The Rtriv+ plan is a paid subscription available on a monthly basis (€7.99/month) or annually (€59.99/year). It includes 250 saves per month, a daily quota of up to 10, video transcription, unlimited collections, and advanced friction features. 4.3 Free Trial A 7-day free trial is offered upon first subscription to Rtriv+. No charge is made during the trial period. At the end of the trial, the subscription is automatically activated unless cancelled before the trial ends. 4.4 Payment and Renewal Subscriptions are managed via Apple In-App Purchase. Payment is charged through the user's App Store account. Subscriptions renew automatically at the end of each period unless cancelled before the renewal date. 4.5 Cancellation Subscriptions can be cancelled at any time from App Store settings (Settings > Your Name > Subscriptions). Cancellation takes effect at the end of the current billing period. No partial refund is issued for an already-started period.

5. Right of Withdrawal

For users in the European Union, the 14-day right of withdrawal does not apply to digital content whose execution has begun with the user's prior consent. By subscribing to Rtriv+ and immediately accessing premium features, you expressly acknowledge waiving your right of withdrawal. If you have not yet accessed any premium features, you may exercise your right of withdrawal within 14 days of subscription by contacting contact@rtriv.io.

6. User Content

6.1 User Responsibility You are solely responsible for the content you save via Rtriv. By using the service, you agree not to save, share, or process content that is:

• unlawful, defamatory, or infringing on third-party rights
• pornographic involving minors
• promoting crimes, hatred, or discrimination
• infringing intellectual property rights

6.2 Personal Content Saved content remains the property of the user. Rtriv does not use your content for commercial, advertising, or AI training purposes. 6.3 AI Processing URLs and metadata of saved content are sent to OpenAI (GPT-4o-mini) for enrichment. This processing is subject to OpenAI's privacy policy. No personally identifiable information (email, name) is transmitted to OpenAI.

7. Account Suspension and Termination

Rtriv reserves the right to suspend or delete an account without prior notice in cases of:

• violation of these Terms of Use
• abusive use of the service (quota circumvention, unauthorized access attempts)
• detection of unlawful content

In the event of suspension for a Terms of Use violation, no refund for the current period will be issued.

8. Changes to the Service and Terms

Rtriv reserves the right to modify features, pricing, and these Terms of Use. In the event of a material change, users will be notified by email at least 30 days before the changes take effect. Continued use of the service after that date constitutes acceptance of the new terms. Pricing in effect at the time of subscription is guaranteed for the duration of the current billing period (no retroactive increases).

9. Limitation of Liability

Rtriv is provided "as is." To the fullest extent permitted by applicable law, Rtriv shall not be liable for:

• data loss due to technical failure
• temporary unavailability of the service
• inaccuracies in AI-generated enrichments
• deletion of source content on third-party platforms

Rtriv's liability is limited to the amounts actually paid by the user in the preceding 12 months.

10. Intellectual Property

The Rtriv application, its design, code, and brand are the exclusive property of Benoit Gainnier. Any reproduction, even partial, is prohibited without prior written authorization.

11. Governing Law and Jurisdiction

These Terms of Use are governed by French law. In the event of a dispute, and failing amicable resolution, French courts shall have exclusive jurisdiction. For consumer disputes, you may also use the EU online dispute resolution platform: https://ec.europa.eu/consumers/odr
